Joint ownership - when real estate stops being common.


According to a decisive and cheerful formula, joint ownership of real estate by spouses, which concerns many, can lose its magic in the event of a divorce. Lawyer Oksana Filipova explains that after the divorce, the official property ceases to be 'ours' and becomes 'yours' or 'mine'.
'In the event of a divorce, the spouses either agree among themselves or turn to the court - it is at this point that it is determined who owns which property', the lawyer explains.
After divorce, the status of joint ownership is lost:
- housing acquired during marriage (except for inherited or gifted);
- land plots, cars, garages;
- other movable and immovable property acquired together.
Division of property as a key stage in terminating commonality
It is important to carry out the division of property taking into account all details to avoid misunderstandings. This can occur either by agreement of the parties or through the court. After the division, everyone receives their separate ownership, and the status of commonality automatically disappears.

A marriage contract is like a backup option for property discussions. Thanks to it, one can determine in advance what is common and what is personal. The usual provisions in such a document involve defining rules that illustrate what 'this is yours', 'that is mine'.
