Drivers face fines for 'other people's' traffic violations: how to avoid this.

Ukrainians are facing unjust fines for traffic violations they did not commit, reports the publication 'Avtotema' citing lawyers.

Many times, former owners of cars receive fines for traffic violations committed by new owners. This occurs because the car was not properly re-registered in the Ministry of Internal Affairs database.

If violations are recorded by automatic cameras, fines are sent to the officially registered person listed as the car owner. In cases where the car was sold under a general power of attorney but the legal owner has not changed, the previous owner still has to pay the fines.

There are several ways to solve this problem:

Method 1: Come to an agreement with the new owner

• Contact the person who is actually using the car. Explain the situation to them and ask them to visit the police station where they should acknowledge the violation, write a statement, and pay the fine.

Method 2: Register a new user

The new owner can register themselves as the user of the car through the driver's electronic cabinet or the Ministry of Internal Affairs service center. After that, the responsibility for traffic violations will pass to the new owner, and fines will not be sent to the previous owner.

Method 3: Cancel the power of attorney

• If the new owner does not wish to cooperate and resolve the issue, the power of attorney can be canceled through a notary. This will deprive them of the right to use the car.

Method 4: Properly document the sale

• In order to avoid similar situations in the future, it is important to officially document the sale through the Ministry of Internal Affairs service centers. This approach guarantees the fixation of the change of ownership in the registries, completely lifting obligations from the previous owner.

Although selling a car through a power of attorney may seem like an easier option, it carries risks for the former owner. The best solution is a complete re-registration of the vehicle to the new owner, which will reliably protect you from problems with fines and other troubles.
